Custody Evaluations

I offer Custody Evaluations.

Oregon Law ORS 107.137 establishes the standards to be considered when determining child custody:

  • The emotional ties between the child and other family members
  • The interest of the parties and their attitude towards the child
  • The desirability of continuing an existing relationship
  • The abuse of one parent by the other
  • The parents’ willingness to share

After the report is completed and reviewed by the parents and attorneys, the evaluator then presents their findings and recommendations at a settlement conference with the parents, their attorneys, and a mediator (if desired). If the case does not settle, the evaluator will testify. The cost for this testimony is charged separately, in addition to the evaluation fee.

I conduct Custody and Parenting Time Studies that are either court-ordered or per stipulation. As a forensic evaluator, I am a neutral and objective third party. The work I do is to assist the court, regardless of who pays my fees.

 

Process

I conduct a thorough, structured evaluation that follows SFLAC and AFCC guidelines. The evaluation includes (but is not limited to):

  • 3-4 Individual Interviews of each party
  • Individual Interview(s)/Parent-Child Observations with each child, depending on age
  • Home Visits, as I deem necessary
  • Psychological Testing and/or additional testing as I deem appropriate
  • Behavior rating scales regarding the child(ren)
  • Interviews of collateral contacts
  • Review of supporting documentation

Timeline

Prior to beginning a Custody and Parenting Time Study, I must receive:

  • Signed court order appointing me as evaluator
  • Signed Service Agreement
  • Retainer payment

In general, a final report can be expected approximately 90 days after commencement of the study. However, this is only an estimate. The actual completion date is affected by many factors specific to the individual case. I highly prefer to complete the final report at least two weeks prior to the court date.
